The Inter-American Development Bank (IDB), in coordination with the General Directorate of Water (DGA) of the Ministry of Public Works of Chile, is calling on consulting firms to submit proposals to provide technical, legal-regulatory and methodological support in the preparation of the three regulations derived from Law No. 21,813 on the extraction and use of seawater for desalination.

1. Technical scope of the three regulations

Regulation No. 1 (Life cycle of the concession or destination): Define procedures, deadlines, simplified regime for smaller-scale projects, interoperability of information, role of the DGA's technical report and measures for closure or temporary continuity of the service (Arts. 18, 27 and 42).

Regulation No. 2 (Contribution for human consumption and sanitation): Formulate the technical, territorial, sanitary and economic criteria to evaluate the appropriateness of requiring a contribution of desalinated water for human consumption and sanitation, regulating costs, flows and coordination with the SISS and the DOH (Art. 9).

Regulation No. 3 (Procedure of the National Desalination Strategy): Regulate the stages of citizen participation, regional consultation and evaluation of the procedure for the preparation of the National Desalination Strategy, as well as systematize the preliminary strategic inputs for its first version (Art. 3).

2. Participatory tables and methodological development

Governance and inter-institutional dialogue: Design and facilitate the execution of technical-legal and procedural roundtables with relevant actors, coordinating the guidelines with the Office of Sectoral Authorizations and Investment (OASI) of the Ministry of Economy.

Matrix of subjects and risk management: Develop an integrated diagnosis of legal, technical, climatic and socioeconomic background, identifying the critical path of regulatory decisions and managing regulatory or operational risks.

Consistency and regulatory harmonization: Ensure the coherence of the proposals with the Water Code, Law No. 21,770, the Framework Law on Climate Change, Law No. 19,880, the regulations on maritime concessions and territorial and water planning tools.

3. Results, drafts and implementation strategy

Consolidated drafts: Support the DGA in the progressive drafting of the preliminary, systematized and final versions of the three regulations.

Processing and consultation strategy: Propose recommendations and roadmaps for the process of public consultation, inter-ministerial coordination, administrative approval and operational monitoring of the new legal framework.
