Details
Gegenstand des Auftrags sind Planungsleistungen, bestehend aus den Leistungsbildern - Technische Ausrüstung HLS (§§ 53 ff. HOAI i. V. m. Anlage 15 HOAI, Anlagengruppen 1, 2, 3, 7 und 8 gem. § 53 Abs. 2 Nr. 1, 2, 3, 7, 8 HOAI ), Grundleistungen gemäß Leistungsphasen (LPH) 3-9. Mit Vertragsschluss erfolgt zunächst eine Beauftragung der Entwurfsplanung (System- und Integrationsplanung) nach LPH 3 und der Genehmigungsplanung nach LPH 4 HOAI. Der AG hat hierbei das einseitige Recht (Option), den AN entweder einmalig oder sukzessive (d. h. nach Fertigstellung der zuletzt übertragenen Leistungen) mit einer oder mehreren weiteren Leistungsphasen oder (Teil-) Leistungen daraus (z.B. einzelnen Leistungen oder Teilen von Leistungen) zu beauftragen (stufenweise Beauftragung). Ein Anspruch des AN auf Weiterbeauftragung besteht nicht.
Lots Lot 1 — HLS-Planung Erweiterungsbau Kinder- und Jugendpsychiatrie Marien-Hospital gGmbH: Gegenstand des Auftrags sind Planungsleistungen, bestehend aus den Leistungsbildern - Technische Ausrüstung HLS (§§ 53 ff. HOAI i. V. m. Anlage 15 HOAI, Anlagengruppen 1, 2, 3, 7 und 8 gem. § 53 Abs. 2 Nr. 1, 2, 3, 7, 8 HOAI ), Grundleistungen gemäß Leistungsphasen (LPH) 3-9. Beauftragt werden mit Zuschlagserteilung zunächst nur die Leistungsphase 3 und 4. Hinsichtlich der Beauftragung der weiteren Leistungsphase hat der Auftraggeber ein Optionsrecht (einseitiges Recht des Auftraggebers; kein Rechtsanspruch des Auftragnehmers). Voraussetzung für die Beauftragung der weiteren Leistungsphasen ist die vertragsgemäße Leistungserbringung des Auftragnehmers bezüglich der jeweils vorangegangenen Leistungsphasen, ohne dass bei Vorliegen dieser Voraussetzung ein Rechtsanspruch des Auftragnehmers auf Beauftragung der weiteren Leistungsphasen besteht.
