The Ministry of Health (MoH) of the Republic of Indonesia has received loan financing from the World Bank to support the implementation of the Indonesia Health System Strengthening (IHSS) Project, with total funding amounting to EUR 3.7 billion. The IHSS Project operates at an unprecedented scale, serving over 10,000 health facilities across Indonesia's 6,500 inhabited islands, involving high-volume and complex procurement of medical and laboratory equipment. Given this complexity, MoH requires additional capacity to strengthen its commercial documentation, compliance arrangements, and governance processes. To address this, MoH intends to engage a suitably qualified consulting firm to provide concurrent commercial compliance advisory and review support. The selected firm will work in close coordination with the Inspectorate General (IG), the probity auditor, and the World Bank to ensure alignment and avoid duplication of efforts. The consulting services ("the Services") consist of concurrent commercial compliance audit and advisory support to MoH for the implementation of the IHSS Project, with a focus on transactions, engagements, and communications with vendors, suppliers, and other private sector actors across the SOPHI, SIHREN, InPULS, and project management components. The scope of services will include, but not be limited to, the following: (1) commercial compliance reviews of vendor engagements and procurement transactions; (2) design and implementation of a commercial documentation and indexing framework; (3) risk identification and mitigation in commercial practices; (4) preparation of a Commercial Compliance Whitepaper; and (5) capacity building and training for MoH staff. The assignment is expected to require approximately 120 professional staff-months over the implementation period. The Ministry of Health (MoH) now invites eligible firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide sufficient information demonstrating that they have the required qualifications and relevant experience to perform the Services (including the name and location/country of the Client, type and scope of services provided, period of contract, contract amount, role of the firm, starting and completion dates, key output delivered and experts involved in the assignment). The shortlisting criteria are:

Legal Status and Registration: The firm must be a legally registered entity with a valid business license, and possess national and/or international accreditations/registrations (e.g., ISO 37001, ISO 9001, or equivalent certification). Core Business and Years in Business: Minimum ten (10) years of proven experience in any of the following core business areas: commercial auditing, compliance review, and probity assurance. Other line of business such as strategic advisory related to procurement, contracting, and risk management will be considered as an advantage. Relevant Project Experience: Successfully implemented at least three (3) similar assignments within the last seven (7) years, demonstrating experience in any of the following areas: commercial compliance audits or reviews in the public sector or health services; development of compliance frameworks or governance-oriented whitepapers; strategic advisory support in procurement and contracting processes; relevant project experience should be similar in nature, complexity, and scale to the current assignment, including key components such as commercial compliance review, procurement advisory, and risk assessment.

Similar experience in any of the above areas under projects financed by Multilateral Development Banks (MDBs) such as the World Bank, ADB, AIIB, and IsDB, is an advantage.

Experience in establishing knowledge management systems, databases, and tested methodologies to support the implementation of nationwide projects is an advantage.

Technical and Managerial Capability of the Firm: Availability of a qualified team of multidisciplinary experts with demonstrated competencies in law, auditing, risk management, documentation, and information systems.

The qualifications and experience of Key Experts shall not be included in the shortlisting criteria. Key Experts will not be evaluated at the shortlisting stage. The MoH will evaluate the Expressions of Interest (EOI) and develop a shortlist of qualified firms. Shortlisted firms will subsequently be invited to submit full technical and financial proposals in accordance with the World Bank's “Procurement Regulations for IPF Borrowers” Fifth Edition September 2023 (“Procurement Regulations”). The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” Fifth Edition September 2023 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest. The Consultants may associate with other firms to enhance their qualifications but shall clearly indicate in EOI whether the association is in the form of a Joint Venture (JV) and/or a sub-consultancy arrangement. In the case of JV, the EOI shall clearly identify the lead member authorized to represent the JV, and all JV members shall be jointly and severally liable for the entire assignment if selected.
