Das Landesamt für Zentrale Polizeiliche Dienste Nordrhein-Westfalen beabsichtigt, im Zuge des vorliegenden Offenen Verfahrens mit einem Wirtschaftsteilnehmer eine Rahmenvereinbarung über die Lieferung von permanent flammhemmenden Einsatzshirts All Seasons für die Einsatzkräfte der Polizei des Landes Nordrhein-Westfalen abzuschließen

Lots Lot 1 — Abschluss einer Rahmenvereinbarung über die Lieferung von permanent flammhemmenden Einsatzshirts All Season für die Polizei NRW: Im Hinblick auf die Rahmenvereinbarung werden keine Mindestabnahmemengen vereinbart. Nach Rechtsprechung des EuGH vom 17.06.2021_RS C - 23/20 - ist der Auftraggeber zur Sicherung der Transparenz und Diskriminierungsfreiheit im Wettbewerb dazu verpflichtet, eine Höchstmenge anzugeben. Eine Abrufverpflichtung kann daraus nicht abgeleitet werden. Der Auftraggeber schätzt, dass über die gesamte Vertragslaufzeit ein Bedarf von ca. 25.000 Stück Einsatzshirts All Seasons besteht. Die Höchstmenge der anliegenden Rahmenvereinbarungen wird auf 30.000 Stück beziffert.
