7. Ker naročnik v času izvedbe postopka javnega naročanja ne more vnaprej natančno določiti dejanskih potreb oziroma količin, bo z izbranim ponudnikom sklenil okvirni sporazum. Naročnik bo na podlagi izvedenega postopka javnega naročanja z izbranim ponudnikom sklenil okvirni sporazum z enim gospodarskim subjektom. Količine, navedene v ponudbenem predračunu oziroma popisu del, predstavljajo ocenjeni obseg del za potrebe priprave in primerjave ponudb. Naročnik se ne zavezuje naročiti vseh navedenih količin in ne zagotavlja minimalnega obsega naročil. Dela bodo izvedena skladno z dejanskimi potrebami naročnika in pod pogoji ter po cenah na enoto, določenih v okvirnem sporazumu in ponudbenem predračunu. Izvajalec bo izvedena dela obračunal na podlagi dejansko izvedenih in s strani nadzornega organa potrjenih količin ter po cenah na enoto iz ponudbenega predračuna. Najvišja skupna vrednost vseh posameznih naročil, oddanih na podlagi okvirnega sporazuma, znaša 243.442,62 EUR brez DDV oziroma 297.000,00 EUR z DDV. Naročnik ni dolžan izčrpati celotne navedene vrednosti. Izbrani ponudnik iz naslova manjšega dejansko naročenega obsega del od ocenjenega obsega nima pravice do povračila izgubljenega dobička, odškodnine ali drugega nadomestila.
