The Product Service Code (PSC) designation is 5820 – Radio and Television Communication Equipment, Except Airborne The Nevada Army National Guard requires twelve (12) 150 Watt Mini Transit Cases and 16' Whip Antennas to support the L3 Harris AN/PRC-160(V)1 radios.  This is a brand name only requirement.  See the attached “Limited Competition Request - Redacted” justifying name branded L3 Harris OEM item only. NOTE:  This is an Unfunded Requirement.  Clause 52.232-18 Availability of Funds for the Next Fiscal Year (Apr 1984) applies to this acquisition.  Fiscal Year 2026 funding is not currently available, but is anticipated. The provision at 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services, applies to this acquisition. Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, with the quote. PROVISIONS & CLAUSES The following provisions and clauses apply to this solicitation and are included by either reference or full text as provided below and can be accessed at https://www.acquisition.gov. Addendum to 52.212-1 Instructions to Offerors-Commercial Items (NOV 2021) (a) To assure the timely and equitable evaluation of quotations, vendors must follow the instructions contained herein. Vendors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors and sub-factors, if applicable. (b) SAM (System for Award Management): to be considered for a contract award, the company must be registered and active in the SAM database at the time of submission of offer at: www.sam.gov. (c) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(e) Additional Information:

(1) All offers will be reviewed for timeliness. If the offer is received after the closing date, the offer may not be considered. (2) Any resulting contract will be awarded to the vendor whose offer is most advantageous to the government. (3) The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.
