KG430 Lüftungstechnik - Neubau einer Lüftungsanlage Zusätzlich zu der Herstellung der Raumlufttechnischen Anlage ist die optionale Beauftragung von Wartungsleistungen Bestandteil dieser Ausschreibung. Die Preise für die Wartungsleistung müssen – neben den Preisen für die Hauptleistungen - von den Bietern in das Leistungsverzeichnis eingetragen werden und fließen in die Angebotswertung ein. Die Wartungsleistungen können nach Bedarf des Auftraggebers optional abgerufen werden, spätestens zum Zeitpunkt der Abnahme der hergestellten Anlage. Die Laufzeit des Wartungsvertrages beträgt 5 Jahre ab Abnahme. Es besteht keine Verpflichtung des Auftraggebers zur Inanspruchnahme der Option. D.h. der zukünftige Auftragnehmer hat keinen Rechtsanspruch auf den Abruf der Wartungsleistungen, ist aber verpflichtet, die Wartungsleistung bei Inanspruchnahme der Option durch den Auftraggeber zu erbringen. Mit Zuschlag wird das Optionsrecht Vertragsbestandteil. Die Ausübung des Optionsrechts durch den Auftraggeber stellt keinen neuen Auftrag im rechtlichen Sinne dar.
