Assignment Title: Establishing correspondence tables regarding the legal and regulatory framework of Ukraine in suppor

Assignment Countries:

- Ukraine ASSIGNMENT DESCRIPTION The WorldBank Group is currently providing technical assistance regarding the preparations required for Ukraine to be able tojoin the Single Euro Payments Area (SEPA). The criteria and the process for a country to be included withinthe SEPA geographical scope have been established by the European PaymentsCouncil (EPC) through the SEPA Participation Criteria(Criteria). Demonstrating compliance against the Criteria is based on a formalapplication submitted to the EPC in the form of a legal opinion which isaccompanied by several so-called correspondence tables detailing complianceagainst the SEPA Criteria. A SEPA application is in most instances submitted bya Central Bank on behalf of the Payment Service Providers (PSPs-as defined under PSD2) operating in the applicant country. The Board of the EPCwill ultimately make the decisions on whether to admit an applicant country tothe SEPA geographical scope, supported by a statement of non-objection issuedby the European Commission. The assessment of the level of compliance by anapplicant country against the SEPA Criteria, is undertaken by both the EPC andthe European Commission. The objective of the assignment is to prepare comprehensive correspondence tables comparing Ukraine’s legal and regulatory framework with the relevant EU requirements for SEPA participation.

More specifically, the assignment will:

- Conduct an article-by-article comparison of relevant EU legislation with Ukrainian laws and regulations in the areas of payments, banking, and AML/CFT. - Assess whether Ukraine’s framework is fully compliant, partially compliant, or non-compliant with each applicable provision. - Identify legal and regulatory gaps that need to be addressed before Ukraine submits its formal SEPA application. - Provide the evidence needed for relevant authorities to demonstrate substantial equivalence with the SEPA Participation Criteria to the European Payments Council and the European Commission.
