Details

Postopek oddaje naročila bo izveden skladno z 31. členom ZJN-3, ki določa, da lahko naročnik v postopku javnega naročanja povabi k sodelovanju le invalidska podjetja in zaposlitvene centre, kot jih določa zakon, ki ureja zaposlitveno rehabilitacijo in zaposlovanje invalidov. Naročnik bo storitve oddal invalidskemu podjetju, saj je po določbi 1. odst. 62. člena Zakona o zaposlitveni rehabilitaciji in zaposlovanju invalidov (ZZRZI) dolžan zaposlovati invalidne osebe, kvota za zaposlovanje invalidnih oseb na podlagi določbe 3. člena Uredbe o določitvi kvote za zaposlovanje invalidov pa znaša 3 % od celotnega števila zaposlenih, glede na razvrstitev v dejavnost H (Promet in skladiščenje) – šifra dejavnosti 49.500 – Cevovodni transport. Glede na trenutno število zaposlenih bi moral imeti naročnik zaposlenih pet invalidov. Glede na to, da naročnik ne zaposluje invalidov, bo na podlagi 64. člena ZZRZI zakonsko obveznost zaposlovanja invalidov izpolnil s sklenitvijo pogodbe o poslovnem sodelovanju z invalidskim podjetjem kot nadomestno izpolnitev kvote.
